Can I make a claim for compensation?

If you have suffered physical injury and/or or psychological injury in the last 3 years as a result of another party’s negligence, you are entitled to be compensated.

If you are over 18 and your accident happened in the UK, you have just three years in which to lodge your claim for compensation at Court. If you were under 18 or under a disability at the time of accident, the three year period will commence from your 18th birthday or from when your disability ceases. But it is better not to delay seeking advice after an accident.

This three year role does have exceptions to include CICA claims and claims arising from an accident at sea or in the air.

How long will my claim take?

The length of time it takes to settle a claim will depend on the severity of your accident and injuries and whether liability is admitted or not. For instance, an uncomplicated claim can settle in just a few months whereas a more serious injury will take longer sometimes years. Who will know that I’m making a claim?

Our team of expert injury lawyers will handle your claim with confidentiality. Your privacy will be respected, but obviously us, the party you are claiming against and any other parties needed to progress your claim will be aware of your claim.

Please note that as part of the Fraud Prevention process, insurance companies complete a number of enquiries to check details provided to them. This information will be stored and shared with other insurers. Any person who knowingly makes or assists, abets, solicits or conspires with another to make a false report commits a crime. Insurers are then duty bound to inform you that any claim found to be false in nature or through representation or processing, making or supplying articles for use in fraud will be reported to the Police in relation to potential criminal proceedings and you may also be privately prosecuted by the insurers.

I had an accident at work. If I make a claim against my employer, can they dismiss me?

No, it is not a legally justifiable reason for your employer to dismiss you for making an accident claim. If you are dismissed, this could amount to unfair dismissal. It is also important to note that your employer is required by law to take out insurance cover against employee’s accidents in the workplace, so this means their insurers or solicitors will deal with your claim, rather than your employer directly.

What can I claim for?

Myers Lister Price Solicitors, Manchester aim to achieve the maximum compensation for your accident and make sure you’re fully compensated for your physical and psychological injuries and all other consequential losses and expenses incurred.

How much you can claim will all depend on a number of factors such as: how serious your injuries are; how much pain you have suffered and; whether or not you have been left with long term disabilities. Your age and sex will also be taken into account.

Compensation ranges from less than a thousand pounds to many millions of pounds.

The amount of compensation you will receive will depend on a variety of factors and this cannot be answered until such time as you have been examined by one of our medical experts and a report has been prepared. Considerations may include your health prior to the accident, how long the medical expert believes it will take you to recover, and whether your injuries have affected you at work or in your social life. Our team of expert injury lawyers has many years experience in these matters, and will be able to discuss your own case with you. If we are unable to agree how much your claim is worth with the other party’s insurers or solicitors, the matter will need to be decided at Court.

Will I receive any financial help before my case concludes?

Yes, this is a possibility once liability is admitted we can apply for interim payments, which will be made in part settlement against your claim. These interim payments may be for example the pre-accident value of your damaged vehicle or for lost earnings or private medical treatment.

Will I be paid by my employer whilst I’m off work with my injuries?

Your individual Contract of Employment will often determine this and your employer will notify you accordingly. We can look at your contract for you and if your employer does not pay you whilst off work, you may be entitled to other income and in this circumstance we can consider any personal insurance policies you may have or benefits you may be entitled to receive.

I’m not working because of my injuries. Can I claim Benefits?

Any financial support you may be entitled to will depend on your individual circumstances and the severity of your disability or illness.

Disability Living Allowance is a type of benefit for those (under the age of 65) who need help with personal care or have difficulty walking because of physical or mental disability.

Employment and Support Allowance (replaces Incapacity Benefit for new claimants) is another type of assistance for those who are able to work in some capacity and offers personalised support and financial help.

What does ‘no win, no fee’ mean?

At Myers Lister Price Solicitors we can work on your injury claim on a No Win, No Fee basis (also known as a Conditional Fee Agreement), which means you will keep 100% of any compensation awarded to you. If your injury claim is successful, then we in turn can recuperate our costs from the other (losing) party or their insurers.

If your claim is unsuccessful, then you don’t pay our fees incurred but you may be responsible for additional costs known as disbursements and you may still be liable to pay the other successful party’s legal fees. We can protect you against these potential costs and disbursements, by taking out an insurance policy on your behalf, which will run along side your No win, No fee Agreement.

Do I pay you a fee if my claim is successful?

I’ve had a road traffic accident and I have fully comprehensive insurance. Do I have to use my insurers or the solicitors appointed by my Insurers?

No, you do not need to go through your insurers. You must however inform your insurers of any accident you are involved in. We can arrange to collect your damaged vehicle from the scene of accident (if you are unable to drive it/ the car is not suitable for the roads), deliver a replacement hire vehicle to you, organise an inspection of your vehicle and thereafter repairs of your damaged vehicle. Our team will arrange any medical treatment required and seek to recover all other losses to ensure that you obtain the maximum compensation to which you are entitled.

I’ve had a road traffic accident but my vehicle is still roadworthy. Can you provide me with a replacement vehicle when it goes in for repair?

Yes, we will arrange for a hire vehicle so you will not be left without transport whilst your vehicle is off the road being repaired.

Can I still claim compensation for my injuries and other subsequent financial losses incurred if the road traffic accident was my driver’s fault?

Yes, if you were a passenger it doesn’t matter which driver was at fault. You are considered as an innocent party and your claim should be dealt with.
