A recent road traffic accident case saw Rebecca Williams gain £2,250 in compensation from UK Insurance Ltd.
The Accident:
In December 2008, Rebecca, a 20-year-old woman, was travelling in the front passenger seat of a vehicle driven by an individual insured by UK Insurance Ltd when they collided the car into the rear of a stationary vehicle.
Rebecca sustained abdominal, neck and back injuries and brought action against the individual driving the car. Liability was admitted.
Effects:
Rebecca was taken to an accident and emergency department where she was diagnosed as having sustained bruising to her chest wall and abdomen and soft tissue injuries to her neck and lumbar spine. She also experienced disturbed sleep due to physical discomfort. The accident occurred before Christmas and, as a result, Rebecca’s ability to socialise was affected. For approximately six months after the accident she was also unable to wear high-heeled shoes.
The bruising to Rebecca’s abdomen and chest resolved within two weeks from the date of the accident. She continued to suffer disturbed sleep for the first few weeks after the accident. The soft tissue injury to her neck resolved within three weeks, whilst the lower back pain persisted for approximately eight months. The continuous lower back pain resolved within six months, having been acute for the first month. After the first six months, the pain and discomfort persisted although intermittently and their intensity varied daily. Rebecca had fully recovered by approximately eight months after the accident.
The Court Awarded: £2,250 total damages
Breakdown of General Damages: Pain, suffering and loss of amenity.
