An 11 year old girl (the claimant) received £900 for a back injury that she sustained in a Road Traffic Accident on the 17th December 2007. Luckily the girl made a fully recovery within 10 days from the date of the accident.
The accident occurred when the claimant was sat in the rear passenger seat of a stationary vehicle. Her vehicle was hit from behind by the defendant’s vehicle and consequently the claimant was thrown backward and then forwards. The claimant was very frightened and straight away the claimant felt pain in her lower back.
An ambulance was called and she was taken to hospital for a full examination and was prescribed pain killers, which she took for approximately two weeks. The claimant’s back pain was at first moderate to high but the pain gradually lessened and she was fully recovered within 10 days. Due to the accident and back pain the claimant was absent from school for one day.
The defendant admitted liability.
The claimant agreed an Out of Court Settlement in the sum £900 from the defendant for her back pain, suffering and loss of amenity.
