While overall road casualties between September 2010 and September 2011 shows a fall of 5%, the Department for Transport (DfT) has revealed that this same period there was an 8% rise in the number of cyclists killed or seriously injured and of these cyclists approximately 1 in 5 are children.

Are the roads becoming more dangerous for cyclists or are there increased numbers of people cycling causing the rise?

Unfortunately, there is no way of accurately measuring cycle usage.

The government and local councils should be encouraged to look again at road layouts with a view to making roads more cyclist friendly.  In conjunction, promoting better awareness among other road users and increasing training for cyclists must be improved.

Injury compensation lawyers have recently won a compensation case for a protester who suffered a broken arm during a pro-Palestinian demonstration.

The Metropolitan police force has been ordered to pay over £14,000 in compensation to twenty nine year old Kelly Minio-Paluello, who suffered a badly broken arm as a result of being forcibly removed by police from outside the Israeli Embassy in Kensington, West London.

Ms Minio-Paluello, contacted a firm of injury compensation lawyers after being left traumatised by the incident. She claims to be still suffering a slight lack of mobility in her left shoulder joint, which has affected her ability to compete in sports such as swimming and climbing, at the same level as she did before the incident.

The High Court in London was told that Ms Minio-Paluello sustained the injury after a police officer twisted her arm behind her back and pulled her up off the ground outside the Israeli Embassy in Kensington, in January 2009. Lawyers for the Metropolitan police argued that there was a legal reason for the use of force against the protester and that the amount of force used by the officer was both reasonable and proportionate.

During the trial Mr Justice Eder acknowledged that it was important to get the protesters off the ground but the way in which it was done was ‘neither reasonable nor proportionate’. The court ruled in Ms Minio-Paluello’s favour after deciding that the force used was ‘obviously dangerous’ and completely avoidable. The judge awarded the 29-year-old £14,303 personal injury compensation but did not find that any deliberate intention was used to cause injuries to the claimant.

Several Manchester injury lawyers share concerns with many law firms in the UK over David Cameron’s proposed changes to current compensation law. Mr Cameron has promised to “wage war against the excessive health and safety culture” and has said that in future people should take more responsibility for their own safety.

The Prime Ministers remarks to a business audience in Maidenhead, branding health and safety litigation as an “albatross around the neck of British businesses” have annoyed many personal injury lawyers.

Responding to the comments, Association of Personal Injury Lawyers president David Bott hit back raising “grave concerns” that the government could be in danger of making widespread changes which could be potentially detrimental to injured people.

He said: “The danger is that workers could be exposed to an unnecessary risk of injury and then be left with a civil justice system which cuts them off from their right to full and fair redress.”
Bott added that: “Instead of watering down the rules which are designed to protect workers, businesses should be made to feel confident in the knowledge they have nothing to fear from litigation provided they take reasonable steps to prevent needless injury. Any fear businesses have should be for the welfare of their staff, not legal costs.”

The Hazards Campaign branded the prime minister’s comments “disgraceful”. A spokesperson said: “The truly disgraceful part of all of this is the focus on so-called burdens on business while totally ignoring the burden on people at work who are injured, made unwell, disabled and killed.”

The IOSH which is the chartered body for health and safety professionals, was “appalled” at the prime minister’s “unhelpful” comments, pointing out that the health and safety legislative system exists is to prevent death, injury, or illness at work.

The Institution’s head of policy and public affairs, Richard Jones, said: “The problem identified by the Government’s own reviews is not the law, but rather exaggerated fear of being sued, fed by aggressive marketing.”
 He added only simplification of the laws is necessary.

A Southampton grandmother is to receive personal injury compensation after suffering serious injury following a fall in Santa’s grotto.

Joan Dufosse, a seventy three year old from Hedge End in Southampton, was injured whilst visiting Santa at his grotto in the Selfridges store on Oxford Street with her two granddaughters.

As Mrs. Dufoss and her grandchildren prepared to have their photograph taken, Mrs. Dufosse tripped over an icicle shaped Christmas bauble, which had fallen from a nearby Christmas tree, and was sent crashing to the floor. Mrs. Dufosse was rushed to hospital after fracturing her thigh and required major surgery to insert a plate and screws to repair her damaged leg. She has yet to make a full recovery from the incident which happened in November 2009.

Following the accident the injured grandmother launched a claim for personal injury compensation against event management company Melbry Events Ltd, who were responsible for the grotto.

Following a hearing at Southampton County Court, where the judge listened to evidence provided by both Father Christmas and his elf, her claim was rejected on the grounds that the bauble had not been clearly visible and therefore staff at the grotto could not have been expected to remove it.

Mrs. Dufosse and her legal team appealed against the decision. Judges at the Civil Appeal Court, in London overturned the original verdict after hearing the evidence and agreed that the fall was indeed caused by the negligence of Father Christmas and his elf. They ruled that the “offending icicle” should have been spotted and removed.

The exact amount of personal injury compensation Mrs. Dufosse will now receive from Melbry Events Ltd has yet to be decided but, it could be in the region of £30,000.

A bus driver is making a whiplash injury claim against his employer, Lothian Buses for £75,000 compensation after suffering a whiplash injury – in the works canteen.

Robert Young claims to have been left suffering chronic back pain requiring physiotherapy and steroid injections after a chair he was sitting on collapsed during his tea-break.

The 54-year-old, from Preston Terrace in Prestonpans, East Lothian, launched a whiplash injury claim at the Court of Session in Edinburgh for compensation. Mr Young said he had been on his break at the Lothian Buses depot canteen, when a combined table and chair unit he was sitting at “shot backwards”, leaving him and a colleague to fall on the concrete floor.

Mr Young’s injury compensation lawyers said their client had suffered soft tissue injuries to the left elbow and right thigh, chronic lower back pain, and a “whiplash-style” injury to his spine. They added that he now suffered from psychological problems, including “occasional suicidal ideation”, low mood, concentration disturbance and depression.

Mr Young declined to comment on the details of his whiplash injury claim for compensation but confirmed the case was ‘on-going’, while Ian Craig, managing director of Lothian Buses, said it was company policy “not to comment on legal matters”. Mr Young’s compensation case is one of a number of claims that have been launched against the bus operator recently.

An ex policewoman, who was seriously injured when the squad car in which she was travelling was involved in a road traffic accident, is to make a half a million pound road traffic accident claim for compensation.

Former policewoman Jocelyn Lyons from Armagh, in Northern Ireland had been a probationary constable in the Kent force for less than a year when the squad car, in which she was a front-seat passenger, crashed into another vehicle as it rushed to attend an emergency on July 13, 2002.

Ms. Lyons, now 34, was left so badly injured and traumatised by the road traffic accident that she medically retired in 2009 and returned to live with her parents in Armagh. She is now seeking more than £500,000 in a road traffic accident claim for compensation. Ms. Lyons says her life and career were ruined by the trauma of the crash which has left her suffering with mental health issues including suicidal tendencies.

The Kent police force do not deny responsibility for the accident and the injuries sustained by Ms. Lyons, but they do dispute the amount of compensation being claimed. They argue that Miss Lyons mental state was already vulnerable before the accident.

Ms. Lyons road traffic accident claim case, which is being heard at the High Court in London is continuing.

A Tameside man, who was left with permanent spinal damage after being misdiagnosed as a schoolboy, has won an undisclosed six figure in a spinal injury compensation claim pay out.

Twenty three year old Liam Careless, of Stalybridge, was twelve years old when he was taken to the accident and emergency department of the Tameside Hospital by his mum Karen Roberts. He had begun to suffer loss of feeling and complained of paralysis like symptoms in his neck. Liam underwent an X-Ray but was discharged the next day. He was given a soft collar, which he was told to wear if his neck became any more painful and was told he would be fine within a few days.

Liam’s X-Rays had been misinterpreted and the serious damage to his spine had been missed. Liam suffered spinal cord compression which led to him enduring years of pain and suffering both physical and psychological.

Liam underwent a series of operations but because of the failure to spot the problem initially, he now suffers constant pain, finds walking difficult and suffers from lack of balance which results in regular falls.

Had the X-RAY been correctly interpreted, surgery would have resulted in complete recovery. Liam decided to make a spinal injury compensation claim against the Tameside Hospital NHS Foundation Trust, after discovering that his condition could have been cured had he received prompt surgery following his initial complaint.

The Tameside Hospital NHS Foundation Trust admitted full liability and agreed an undisclosed six figure sum in an out of court settlement of Liam’s spinal injury compensation claim which will help pay for his future care and rehabilitation.

A young woman has been awarded an injury compensation claim package worth more than £9 million after suffering serious brain injuries.

Leigh Ann Blinkthorn, now 23, was seven when she was she was struck by a car as she crossed the road to see a family friend.

The force of the impact knocked Ms. Blinkthorn into the air and she suffered life threatening injuries which put her into a deep coma. Due to the extent of her injuries, she now requires around the clock supervision. Her counsel, John Foy QC, said a personality change caused by the injuries meant she could be “quite aggressive” and needed two carers to supervise and look after her at all times.

Settlement of her injury compensation claim has finally been reached, eleven years after the insurers of driver Stephen Hall, of White Rose Close, Norwich, were found liable. The High Court was told the delay was due to legal negotiations and changes to the extent of care required by Ms. Blinkthorn.

Ms. Blinkthorn will receive a £2,875,000 lump sum, followed by tax free, index linked annual payments of £191,758 to cover the cost of her extensive care needs for the rest of her life.

It is believed that the injury compensation claim package is worth in excess of £9 million which is one of the largest compensation settlements of its kind.

Ms Blinkthorn’s parents, Colin and Joy, were told by Mr Justice Popplewell: “I am pleased to be able to approve this settlement, which is fair and very much in Leigh’s best interests.

Charles Howie, an electrical services worker for Spark’s Mechanical Services Ltd, Aberdeen, sustained serious injury, including five broken ribs and a collapsed lung, after falling from a scaffolding tower at work.

At a recent hearing, Spark’s Mechanical Services Ltd, admitted to breaching the Health and Safety at Work Act. The company were fined £10,000 for their role in the man’s injuries.

Mr Howie had been working at Iceberg Ltd, a Fraserburgh fish processing factory. He had been instructed to remove a refrigeration unit from the factory’s cold store. He was in the process of removing the unit from the ceiling of the cold store when four of the eight bolts holding the unit in place, failed.

Consequently the refrigeration unit slipped from its mooring and crash into the scaffolding. As a result, Mr Howie was thrown from the scaffolding and sustained serious injuries which led to him remaining off work for a total of five months.

The Health and Safety investigation revealed Mr Howie’s employers had neglected to organise adequate support for the refrigeration unit during its removal. In addition the court was also told that the top guard rails were missing from the working side of the scaffolding platform. Health and Safety Inspector John Radcliffe said: “The company’s method of carrying out this type of work appeared to have evolved from custom and practice devised by employees rather than what was actually safe.”

Motorcyclist David Scott Buchan has recently been awarded a substantial sum for his motorcycle accident compensation claim.  The other party involved in the accident, a car driver,  admitted one-third liability.

Mr Buchan was just 21 when in 2005 he sustained brain and facial injuries as a result of a collision with a car just half a mile from his home in Watford.

Mr Buchan was left fighting for his life in intensive care. As well as his physical injuries he has also suffered long-term depression, anxiety, fatigue and impaired sight, taste and smell. As a result of the collision he has been unable to return to work and has been left needing to walk with a stick. Mr Buchan lives with his mother who was praised by the judge for her dedication, love and support.

Six years after the crash a High Court judge, Mr Justice Langstaff, approved a “substantial” settlement which will allow Mr Buchan to pay for his future care.

The exact amount of the compensation will not be disclosed but even after a two-thirds deduction, it is a significant figure. Mr Justice Langstaff said that he had “no hesitation” in approving a substantial settlement as it will be needed to pay for Mr Buchan’s intensive support and rehabilitation.
